Terms and Conditions

SYKE Travel & Tours

These Terms and Conditions govern the use of the websites operated by SYKE Travel & Tours including bantayanisland.info, travelvisayas.org and smaks.travelvisayas.org.

1. Definitions

The following terms apply throughout these Terms and Conditions:

  • Company – SYKE Travel & Tours.
  • Client / Customer / User – any person making a booking or using this website.
  • Website – travelvisayas.org, bantayanisland.info and related platforms.
  • Services – tours, transfers, accommodations, travel arrangements, flights and tourism services.
  • Suppliers – airlines, hotels, boat operators, transportation providers and other third-party partners.
2. Accreditation

SYKE Travel & Tours is an accredited tourism service provider registered with the Department of Tourism (DOT), Philippines.

The company acts as a travel facilitator and booking intermediary for certain services provided by third-party suppliers.

3. Online Bookings

Bookings made through our website are processed through an online booking system.

A booking is confirmed only when:

  • Payment has been successfully processed, and
  • A booking confirmation or travel voucher has been issued.

SYKE Travel & Tours reserves the right to decline bookings in case of pricing errors, availability issues, or suspected fraudulent transactions.

4. Pricing and Availability

All prices are displayed in Philippine Peso (PHP) unless otherwise stated.

Prices may change due to:

  • Seasonal price adjustments
  • Supplier price changes
  • Fuel surcharges
  • Government taxes or fees

For multi-destination travel packages the final price may vary by up to 10% due to supplier rate adjustments.

5. Payment Policy

Credit Card and Online Payments

Payments made via PayPal, credit card, HitPay or other online payment providers are processed through secure third-party gateways.

Once payment has been processed successfully, the booking will be confirmed.

Bank Transfer or Cash Payment

  • A prepayment of at least 50% may be required.
  • Reservations remain provisional until payment is received.
  • Proof of payment must be sent to syke@travelvisayas.org.

The remaining balance for multi-day tours is due 14 days before arrival.

6. Chargebacks and Payment Fraud

Chargebacks initiated after confirmed bookings or completed services may result in:

  • Immediate cancellation of services
  • Administrative fees
  • Legal action if necessary

Clients must contact SYKE Travel & Tours first to resolve any payment disputes.

7. Supplier Responsibility / Third-Party Providers

SYKE Travel & Tours acts solely as an intermediary, booking facilitator, and coordination agent between the client and independent third-party service providers.

Unless expressly stated otherwise, SYKE Travel & Tours does not own, operate, manage, or control airlines, vessels, ferries, buses, vans, cars, tricycles, hotels, resorts, tour equipment, or other transportation and tourism infrastructure used in the delivery of booked services.

All such services are provided by independent suppliers operating under their own terms and conditions, operational policies, safety standards, insurance arrangements, and applicable laws and regulations.

Payments collected by SYKE Travel & Tours may include the cost of the third-party service as well as a facilitation fee, coordination fee, service charge, or commission retained by SYKE Travel & Tours for arranging and administering the booking.

SYKE Travel & Tours cannot be held responsible for supplier-related issues including, but not limited to:

  • Schedule changes
  • Transportation delays
  • Equipment malfunction
  • Supplier cancellations
  • Operational disruptions
  • Safety decisions made by the supplier

In such cases, the terms and conditions, limitations, and liability policies of the relevant supplier shall apply. By confirming a booking, the client acknowledges and agrees that the actual provision and execution of such services are the sole responsibility of the respective third-party provider.

8. Travel Documentation

Clients are responsible for ensuring they possess valid travel documents including:

  • Passports
  • Visas
  • Vaccination certificates
  • Government permits

SYKE Travel & Tours is not responsible for denied boarding or immigration issues resulting from incomplete documentation.

9. Cancellation Policy

Day Tours & Transfers

Cancellations made at least 48 hours prior to the scheduled departure time are eligible for a full refund.

Hotels & Accommodations

Cancellations made at least 48 hours before the scheduled arrival date may be eligible for a refund of up to 50% of the total booking amount. Reservation or booking fees are non-refundable.

Multi-Day Tours

  • 70% refund if cancelled 60 days or more before departure
  • 50% refund if cancelled 14–59 days before departure
  • 0% refund if cancelled 0–13 days before departure

Flights

Flights between Cebu and Bantayan Island booked through our website are strictly non-refundable, regardless of the reason for cancellation, including voluntary cancellation, missed flights, or schedule changes by the passenger.

Refund Processing

All approved refunds are subject to applicable transaction, banking, and payment processing fees, which shall be borne by the client.

Weather Disruptions & Force Majeure

In cases where services are affected by weather conditions, natural disasters, transportation disruptions, or other events beyond the control of SYKE Travel & Tours or its suppliers (force majeure), refunds, rescheduling, or alternative arrangements will be determined reasonably and fairly in accordance with Philippine consumer protection laws and the policies of the respective service providers.

10. Weather and Force Majeure

SYKE Travel & Tours is not responsible for cancellations or delays caused by circumstances beyond our control including:

  • Weather conditions
  • Natural disasters
  • Government restrictions
  • Transportation disruptions

Alternative arrangements or partial refunds may be offered depending on supplier policies.

11. Limitation of Liability

To the fullest extent permitted by applicable law, SYKE Travel & Tours shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with:

  • the acts, omissions, negligence, defaults, cancellations, delays, or service failures of third-party suppliers or operators;
  • accidents, injuries, illness, death, or damage occurring during or in connection with services provided by third-party suppliers;
  • loss, theft, or damage to personal belongings, baggage, or valuables during tours, transfers, accommodations, or transportation services;
  • force majeure events, including but not limited to adverse weather, natural disasters, government actions, transport interruptions, fuel shortages, strikes, safety restrictions, or port closures;
  • loss of enjoyment, missed connections, missed departures, or business interruption arising from delays, cancellations, or supplier failures.

As an intermediary and booking agent, SYKE Travel & Tours does not assume liability for the actual operation, execution, safety, or performance of services rendered by independent third-party providers. Any claim relating to the delivery of such services shall, to the extent permitted by law, be directed to the relevant service provider.

Where liability of SYKE Travel & Tours cannot be excluded under applicable law, such liability shall be limited, to the maximum extent permitted by law, to the amount actually paid by the client to SYKE Travel & Tours for the specific service giving rise to the claim.

Nothing in these Terms and Conditions shall exclude or limit liability for fraud, willful misconduct, or any other liability that cannot lawfully be excluded or restricted under applicable law.

12. Intellectual Property

All website content including text, images, videos and graphics are the property of SYKE Travel & Tours or its licensors.

Unauthorized use or reproduction of content is strictly prohibited.

13. Website Use

Users agree not to:

  • Make fraudulent bookings
  • Disrupt website functionality
  • Upload malicious software
  • Misrepresent their identity
14. Privacy and Cookies

This website uses cookies to improve user experience and website functionality.

By using this website, you consent to the use of cookies.

15. Governing Law

These Terms and Conditions are governed by the laws of the Republic of the Philippines.

Any disputes shall fall under the exclusive jurisdiction of the courts of Cebu City.

16. Amendments

SYKE Travel & Tours reserves the right to modify these Terms and Conditions at any time.

The latest version will always be published on this website.
